Party Wall Matters
Administering the provisions of the Party wall etc. Act 1996
The Party Wall etc. Act provides a framework for preventing and/or resolving disputes in relation to works to party walls, party structures, boundary walls and excavations near neighbouring buildings.
Property owners who wish to undertake work of the kinds described in the Act must give adjoining owners notice of their intentions. This offers adjoining owners the opportunity to consider proposals and to either consent to the works as proposed, in which case the works can proceed, or request that a Party Wall Award is prepared setting out the right to execute, time and manner of the work.
The Party Wall Award generally includes a Schedule of Condition or photographic survey taken prior to the commencement of work. This provides a clear benchmark for the current condition of the adjoining owner’s property and also acts as a reference point in the event of a dispute surrounding damage.
